These General Terms and Conditions (AGB) apply to all contracts involving catering services, bookings (Food truck, event catering, company parties, etc.), and online pre-orders established between Foodeza, Owner: Jobins Thomas Thazhathuveettil, and the customer. Deviating or supplementary conditions by the customer will not be acknowledged unless explicit written agreement is provided.
Offers presented on our website, menus, or promotional material are non-binding. A legally binding contract is only formed upon our written order confirmation (e.g., via email), or through the direct delivery/execution of requested services.
Agreed prices in the respective offer or contract are valid. Unless otherwise indicated, Value Added Tax (VAT) is included. Invoices are due immediately upon delivery of services or at the end of the event without deductions, unless otherwise agreed. For online pre-orders, offered payment methods apply (e.g., cash on pickup, WhatsApp confirmation, PayPal).
If a customer cancels catering or food truck bookings, the following cancellation fees apply:
- Up to 14 days before the event: 20% of the agreed total price
- Up to 7 days before the event: 50% of the agreed total price
- Less than 3 days before the event: 80% of the agreed total price.
Any third-party costs or already incurred expenses (e.g., rental equipment) will be billed fully regardless of cancellation date.
We ensure timely deliveries and service provision as per reasonable standards. Slight deviations in delivery timelines do not entitle customers to claims or deductions.
In regards to liability for damages—regardless of legal reasons—our responsibility is limited to intent and gross negligence. For slight negligence, we are liable only for a breach of essential contractual duties, capped at the foreseeable, contract-typical damage.
The application of the law of the Federal Republic of Germany is agreed upon. Should individual provisions of these General Terms and Conditions become invalid, this shall not affect the validity of the remaining provisions.
